Phillip Mokoena Senior Counsel

Biography:

Phillip Mokoena (Chairman) was admitted to the Johannesburg Society of Advocates in July 1997 and took silk in September 2011. His preferred areas of practice include commercial litigation, arbitrations, labour, administrative and construction law. Philip has appeared in the High Court, the Supreme Court of Appeal, the Constitutional Court, Labour Court, Labour Appeal Court, CCMA, Education Labour Relations Council, South African Local Government Bargaining Council, General Public Service Sectoral Bargaining Council, International Chamber of Commerce in Zurich, Switzerland, Competition Tribunal and Competition Appeals Court.

Bogoshi Bokaba Senior Counsel

Biography:

Bogoshi Bokaba (Deputy Chairman) was admitted to the Johannesburg Society of Advocates in December 1994 and took silk in January 2008. His preferred areas of practice include commercial, corporate, tax and administrative law. He appears primarily before the High Courts, the Supreme Court of Appeal, arbitrations and the High and Supreme Courts of Namibia. Claire Avidon Junior Counsel

Biography:

Claire Avidon was admitted to the Johannesburg Society of Advocates in 2016, and holds BA and LLB degrees from the University of the Witwatersrand and an LLM from the University of Cambridge. Her preferred areas of interest include administrative law, commercial law, competition law, public law and white collar crime.

Ori Ben-zeev Junior Counsel

Biography:

Ori Ben-zeev holds a BA LLB (qualified with distinction) and was admitted to the Johannesburg Society of Advocates in December 2013. Jatheen Bhima Junior Counsel

Biography:

Jatheen’s earliest recollection of what it means to be an advocate was summed up by Joel Joffe in his book The State v Nelson Mandela. He says of Bram Fischer the following- “He had a charm, a great gentleness and a personal sincerity which endeared him to everybody. But he also had the other qualities of outstanding men- a painstaking, conscientious mind; a clear insight; tremendous drive and ability, singleness of purpose; and immense courage and integrity. Bram was the most popular man at the Johannesburg Bar.”

Jatheen obtained a BCom Law degree with specialization in Economics and Public Administration and an LLB degree from the University of Pretoria. He was admitted to the Johannesburg Society of Advocates in December 2015.

He is a general practitioner with particular experience and interest in competition, public interest, labour, administrative, refugee, and commercial matters. Before joining the Johannesburg Bar, Jatheen worked as a Merger Investigator and later as Legal Counsel for the Competition Commission of South Africa.

Jason Brickhill Junior Counsel

Biography:

Jason Brickhill graduated with an LLB (magna cum laude) and holds a Master of Studies degree (with distinction). He was admitted to the Johannesburg Society of Advocates in 2010. His preferred areas of practice include  constitutional, administrative and labour law. He has appeared  in the High Court, Labour Court, Land Claims Court, Supreme Court of Appeal, and the Constitutional Court.

In addition to his practice, Jason has authored a number of textbooks and journal articles on constitutional law; notably, Constitutional Litigation (2013, Juta) and Erasmus: Superior Court Practice (sections dealing with constitutional law). Peter Buirski Junior Counsel

Biography:

Peter Buirski holds a BA Honours LLB degree and was admitted to the Johannesburg Society of Advocates in 1990. His areas of practice include pension and general commercial law, with extensive experience in labour law.

Peter has appeared in the High Court, the Commission for Conciliation, Mediation and Arbitration (CCMA), the Labour Appeal Court and in various administrative tribunals. In the Labour Court Peter has appeared as counsel and has acted as a judge on occasion.

Benny Buthelezi Junior Counsel

Biography:

Benny Buthelezi holds a Bsoc Sci and an LLB degree. He became a member of the Johannesburg Society of Advocates in 2015. His preferred areas of practice are criminal law, constitutional law, public law, competition law and commercial law. Hasina Cassim Junior Counsel

Biography:

After completing her BPharm degree in 1990, Hasina spent several years in the South African healthcare sector including the private hospital, home care, pharmaceutical and managed healthcare sectors. During her tenure in the healthcare sector, Hasina pursued studies in pharmaco-economics and general management. Whilst with Discovery, Hasina had the opportunity to complete an Executive Leadership Programme at the Said Business School, Oxford University. She also served on various representative organisational committees including that of the Council of Medical Scheme’s committee for the development of algorithms for the PMB-CDL conditions, the Pharmaceutical Society of South Africa (PSSA) and the Pharmaceutical Care Management Association (PCMA).
The legal challenges that faced the Healthcare industry at the time, ignited in Hasina an interest in the law. After completing a certificate course in Medicine and Law, she continued with her studies in law and completed her LLB.
In 2015, Hasina joined the Johannesburg Bar as a pupil and having passed the Bar exam, is now a full member of the Johannesburg Bar and an admitted Advocate of the High Court.
Hasina’s first-hand experience in various sectors of healthcare coupled with her recent foray into law now distinguishes her as having a rare combination of skills that puts her in a unique position with regards medico-legal matters.
Hasina recently completed a mediation course through the University of Cape Town’s law@work department and is now qualified to offer her services as a mediator.
Hasina’s legal experience, in addition to medico-legal matters, also includes personal injury matters, family law, commercial law, labour law and administrative law.

Omphemetse Ken Chwaro Junior Counsel

Biography:

Omphemetse Ken Chwaro holds a B.Juris and LLB degrees and was called to the Bar in 1999 as a practising member of the North West Bar, Mahikeng until 2001 when he joined the public service in senior management level in legal services. He came back to join the North West Bar from 2010 until 2016 when he was admitted to the Johannesburg Society of Advocates.
Main areas of interest are administrative, public procurement, regulatory, construction, labour, customary and general commercial law. Alfred Cockrell Senior Counsel

Biography:

Alfred Cockrell was admitted to the Johannesburg Society of Advocates in 1996 and took silk in 2010. He holds a BA LLB and an MA. Morgan Courtenay Junior Counsel

Biography:

Morgan Courtenay holds an LLB and LLM (with distinction) and was admitted to the Johannesburg Society of Advocates in December 2014. Prior to being admitted he practiced as an attorney at the Centre for Child Law. Morgan’s preferred areas of practice include, constitutional, administrative, commercial, and private law.
In addition to his practice, Morgan has contributed to a number of textbooks and journal articles on child rights, notably (2013) “A New Child Justice System for South Africa”, in Winterdyk Juvenile Justice: International Perspectives, Models and Trends (3rd ed.), Toronto: CRC Press. Susannah Cowen Junior Counsel

Biography:

Susannah Cowen has been practising as an advocate since 2001. She started practising in Cape Town and, in 2010, moved to Johannesburg.
Her preferred areas of practice are commercial law, constitutional law, administrative law, land law and customary law. She has appeared in the Constitutional Court, the Supreme Court of Appeal, the High Court (various divisions), the Land Claims Court and regulatory tribunals.

Cornwell Dauds Junior Counsel

Biography:

Cornwell Dauds holds qualifications in law, tax, finance and accounting. He is a member of the Johannesburg Bar where he practises as an advocate. He was educated in South Africa and pursued postgraduate studies at Harvard Law School in the USA and London School of Economics in the UK. Dauds underwent intensive professional training in the art and skills of trial advocacy in the USA. His tax experience includes being a director at the South African Revenue Service (SARS), a tax practitioner at a law firm and a senior corporate tax manager at an audit firm. Dauds has written extensively in his fields of interest, which include competition law, tax law, financial derivatives and financial regulation. He has published a book titled “Dauds on Competition Law: Substantive Issues” which seeks to integrate economic theory into competition policy and regulation for a better understanding of competition law. Mkhululi Duncan Stubbs Junior Counsel

Biography:

Mkhululi Duncan Stubbs was admitted to the Johannesburg Society of Advocates in December 2013. He holds BA and LLB degrees and an LLM degree in which he studied comparative constitutional law, international trade law and international commercial arbitration. Mkhululi’s preferred areas of practice include commercial, public and regulatory law, and particularly international trade and international commercial dispute resolution.

Prior to becoming an advocate, Mkhululi served as a law clerk to Justice Yacoob at the Constitutional Court. James Grant Junior Counsel

Biography:

James has lectured and focused, in his academic career, on criminal law. He completed his psychology honours on the moral reasoning of Moses Sithole, South Africa’s most notorious serial killer. His PhD is entitled “The Responsible Mind in South African Criminal Law” and concerns an investigation of the foundation for the defences of criminal incapacity and involuntariness and of the conditions for criminal responsibility more generally.

He has lectured criminology, the law of delict, criminal procedure, criminal law the law of evidence. He has 15 peer reviewed/accredited publications in the areas of psychological development, the law of delict, the law of evidence, and criminal law, and has addressed international conferences on the compatibility of determinism, neuroscience and criminal responsibility, and the effect of emotion on moral reasoning and criminal responsibility. In addition, his PhD has been accepted for publication as a book – forthcoming.

Biography:

Bruce Leech was admitted to the Johannesburg Society of Advocates in December 1993 and took silk in October 2010. Biography:

Petrus (Piet) Louw Senior Counsel

Biography:

Piet Louw holds B.Iur and LLB degrees and was admitted to the Johannesburg Society of Advocates in 1988. He took silk in 2002. He is a general practitioner, but his preferred areas of practice include general commercial and regulatory work. He has appeared in all the South African superior courts and many of the regulatory tribunals. He has served as acting judge and has frequently participated in arbitrations, both as counsel and as arbitrator. He is a member of the management committee of the Arbitration Foundation of Southern Africa and he is the present chair of the Johannesburg Bar Council.

Biography:

Vincent Maleka, Founding Chairman of Thulamela Chambers, holds the B Proc LLB degrees. He was admitted to the Johannesburg Society of Advocates in July 1989 and took silk in May 2002. Thanyani (Kenny) Manyage Junior Counsel

Biography:

Thanyani Manyage (Kenny) holds a B Iuris LLB qualification and was admitted to the Johannesburg Society of Advocates in November 2005. Prior to becoming an advocate, he was a prosecutor (1993 to 1999) and a magistrate (1999 to 2005). Gilbert Marcus Senior Counsel

Biography:

Gilbert Marcus was admitted to the Johannesburg Society of Advocates in July 1983 and took silk in 1996. His preferred areas of practice include constitutional and administrative, public regulation, competition, media and telecommunications, as well as human rights law. Rudolf Mastenbroek Junior Counsel

Biography:

Rudolf Mastenbroek was admitted to the Johannesburg Society of Advocates in December 2013. He holds a BA LLB (Stellenbosch), a Masters degree in Public Management (Wits) and a H Dip Tax (Rhodes.)

Prior to joining the Bar, he worked for the ANC Head Office, specifically focussing on the local government chapter of the Constitution during the Constitutional Assembly negotiations. After joining the public service, he was part of the process of establishing the Asset Forfeiture Unit within the NPA, and served as legal advisor to the first National Director of Public Prosecutions. Harriet Mutenga Junior Counsel

Biography:

Harriett Mutenga completed her LLB degree at the University of Fort Hare in 2009. She proceeded to the University of Stellenbosch in 2010 where she completed an LLM degree wherein she specialized in intellectual property, labour law, international criminal law and children’s rights. She also completed a mini-thesis, focusing on the role of the Constitutional Court in balancing competing interests, zooming in on whether the limitation clause adequately equips this court for this delicate mandate. She joined the Zimbabwe Exiles Forum, a human rights organization in 2011, and primarily worked with immigrants. Her duties were mainly centered around finding ways to promote social integration between citizens and non citizens. She then joined the Bar in 2012 and was mentored by Ayesha Tiry at the Island Group. Now in her second year of practice, Harriett remains passionate about human rights and public law. Lindiwe Nkosi-Thomas Senior Counsel

Biography:

Lindiwe Nkosi-Thomas holds B Juris and LLB degrees. She was admitted to the Johannesburg Society of Advocates in 1994 and took silk in 2009. Thandi Norman Senior Counsel

Biography:

Thandi Norman holds a B Iuris LLB degree and a Certificate in Shipping. She was admitted as an advocate to the Johannesburg Society of Advocates in June 1992, and was further admitted to the Bisho Bar in January 1997. Thandi took silk in June 2011. Biography:

Michael Williams was admitted to the Johannesburg Society of Advocates in December 2015. Prior to joining the bar he worked as an attorney at an international law firm in Johannesburg.

Biography:

Seena Yacoob holds B Mus, LLB and LLM degrees and was admitted to the Johannesburg Society of Advocates in December 2003. Gordon Aber Door Member

Biography:

Gordon, currently a tenant of 12 King’s Bench Walk in London, commenced practice at the Johannesburg Bar in the late 1980s. He established a busy commercial practice before being called to the Bar of England and Wales in 1996. He specialises in aviation and aviation insurance disputes, which frequently involve complex multi-jurisdictional claims. He is instructed on behalf of a wide range of commercial aviation interests, including airlines, airport owners, charter operators, ground handling companies, aircraft maintenance organisations (and their insurers) in a range of claims.

Gordon has a large aviation, aviation insurance and general commercial practice and he is regularly instructed by leading city law firms to appear in High Court litigation and ADR proceedings. He also advises and appears for the London war risks market and he has been involved in private arbitration proceedings in respect of losses in Libya, Chad and Afghanistan.

Gordon has argued some of the leading aviation insurance cases in the South African High Court and the South African Supreme Court of Appeal and he regularly appears in High Courts in neighbouring countries. Acting for these clients, and their insurers, in ADR proceedings is a growing area of his practice as arbitration and mediation proceedings become increasingly popular.

Victoria Bronstein Door Member

Biography:

Victoria Bronstein has a BA (hons) LLB, Certificate in Economics from the University of the Witwatersrand. She was a recipient of the Helen Suzman Leadership/Chevening Award to study in England and she has an LLM from University College London. She was a clerk of Justice Ackermann at the Constitutional Court of South Africa. She has an associate Professorship at the University of the Witwatersrand, Johannesburg. She has written extensively in the area of provincial powers and specialises in federalism issues at all three levels of government. She has published in the area of Freedom of Expression. She is also a Commissioner of the Broadcasting Complaints Commission of South Africa.
She has expertise in administrative law, structures of government, human rights law, property law and international trade law. She became a door member of Thulamela in July 2016.

Etienne Coetzee Door Member

Biography:

Etienne Coetzee, holds a BA LLB degrees (Stellenbosch University), a LLM degree specialising in fundamental rights and constitutional law (University of Pretoria), and a LLM degree in tax law (University of Pretoria). He has been practising as an advocate since 1989 and as a silk since 2006. Max Du Plessis Door Member

Biography:

Max Du Plessis was admitted to the KwaZulu-Natal Society of Advocates in 2000. His preferred areas of practice are constitutional, administrative, international, competition (with a particular focus on regulatory law) and human rights law. He has appeared before the Constitutional Court, the Supreme Court of Appeal, the High Courts, the African Commission on Human and Peoples’ Rights, the East African Court of Justice, as well as Namibian, Swazi, and Botswana High Courts.

Max is a senior research associate at the Institute for Security Studies in the programme on International Crime in Africa. In this capacity he regularly consults governments, NGOs and international tribunals on matters regarding international criminal law. He holds B Iuris, LLB, LLM degrees and a PhD.

Biography:

Nikki Stein was admitted to the Johannesburg Society of Advocates in December 2015. Her areas of interest are constitutional law and administrative law. Her experience includes litigation on the right of access to health care services and the right to basic education. She has also worked on cases involving administrative law, including procurement systems.

Prior to joining the Bar, Nikki was an attorney at SECTION27, and before that at Bowman Gilfillan Attorneys. She also served as a clerk to Justice Nkabinde at the Constitutional Court. Nikki holds a BA and an LLB from the University of the Witwatersrand, and an LLM from the University of Virginia in the United States.
